A domestic relations order is a specific order that is signed by the family court judge but must be “qualified” by a plan administrator in order to divide certain types of retirement accounts – thus resulting in a “Qualified Domestic Relations Order.” The most common retirement accounts such as 401(k) and 403(b) accounts require a Qualified Domestic Relations Order to complete a final division of the same. Similar division orders are required for pensions, including military pensions and civil retirement systems.
Domestic Relations Orders can also be used to collect past due support payments.
